Terms of Service

Draft. This is a working draft written to match how SkyAccess actually operates today. Replace the bracketed placeholders with your real entity details and have a lawyer review it before this page goes live for real customers or real payments.
1. Who we are
SkyAccess ("SkyAccess," "we," "us") is operated by [Legal entity name, e.g. SkyAccess LLC], a limited liability company organized in [state/country of formation]. SkyAccess is a booking platform that connects travellers with independent, separately certificated air charter operators. SkyAccess does not own or operate aircraft and does not itself provide air transportation. Every flight booked through SkyAccess is operated by a third-party charter operator, identified on the listing before you book.
2. Eligibility
You must be at least 18 years old and able to form a binding contract to book through SkyAccess. By creating an account or submitting a booking request, you confirm this is true and that the information you provide is accurate.
3. How a booking works
Submitting a request is not a booking and is not a charge. Here is exactly what happens:
- You request a flight and place a temporary $1 authorization hold on your card, used only to verify the card is real. This is not a charge.
- The operator confirms availability and the final price. The price shown to you when you requested is a ceiling — if the operator comes back higher, we ask you to approve the new price before anything is charged. You can decline, and nothing is charged.
- Once confirmed at a price you agreed to, payment is taken automatically: by card, or — if you chose bank transfer — by sending the funds yourself within the payment window shown to you (see Section 5).
- Your flight is confirmed once payment is received.
4. Pricing and commission
The price shown to you includes SkyAccess's service fee on top of the operator's own rate. Once an operator confirms a price and you accept it, that price is final — no fuel surcharges, repositioning fees, or other charges are added afterward.
5. Payment methods
Payments are processed by Stripe. SkyAccess does not receive or store your full card number or bank account details.
- Card: charged automatically the moment the operator confirms, to the same card used for the initial $1 hold.
- Bank transfer / wire:once the operator confirms, we send you Stripe-hosted transfer instructions with a reference number. You have a limited window (shown on your booking page) to send the funds. If payment doesn't arrive in that window, the booking is released and nothing is charged.
6. Cancellations and refunds
See our Cancellation & Refund Policy for the full terms.
7. The operator's role
Your flight is operated entirely by the third-party charter operator named on your booking — a separately certificated air carrier, not SkyAccess. Any safety, certification, or membership badges shown (such as ARGUS, IS-BAO, or Wyvern) reflect assessments made by those independent organizations, not a guarantee made by SkyAccess. Questions about the aircraft, crew, or conduct of the flight itself are the operator's responsibility.
8. Your conduct
You agree not to submit fraudulent booking requests, use stolen or unauthorized payment methods, or attempt to circumvent SkyAccess to book directly with an operator you were introduced to through the platform in order to avoid the service fee on a repeat booking.
9. For operators
If you list a fleet on SkyAccess, you agree to honor the price and availability you confirm through any channel (portal, email, phone, or Avi-Go), to keep your pricing and aircraft details accurate, and to the commission and payout terms shown in your operator dashboard when you connect payouts.
10. Limitation of liability
SkyAccess is a booking intermediary. To the maximum extent permitted by law, SkyAccess is not liable for the acts or omissions of any charter operator, including flight delays, cancellations initiated by the operator, or the condition of any aircraft. Where SkyAccess is found liable for anything arising from your use of the platform, that liability is limited to the amount you paid for the booking in question.
11. Governing law
These terms are governed by the laws of [state], without regard to conflict-of-law principles. [Add dispute resolution / arbitration clause here if you want one.]
12. Changes to these terms
We may update these terms as the product changes. We'll update the date at the top of this page when we do.
